Frequently Asked Questions

Q:  What form of dissolution is better for me?  Traditional or Mediation?

Answer:  That’s a difficult question to answer without any further facts, however, most people believe mediation to be a more hands-on method of resolving your differences.  The parties themselves are able to resolve whatever issues are pending between them with a minimum of Court time.  However, in order for mediation to succeed, each party must have an adequate working knowledge of the assets as well as the income and expenses of the marriage.

Q:  How long does a dissolution of marriage take?

Answer:  By traditional methods, it could be anywhere up to several years and you are subject to the Court system’s scheduling.  In mediation, you go at the pace which you are most comfortable with.

Q:  What if I don’t know what all of the assets/liabilities/income/expense are?

Answer:  An effective mediator will provide each of the participants with a working knowledge of this information.  In order for mediation to be successful, both parties must be knowledgeable of these facts.

Q:  I’m afraid my spouse will try to intimidate me.

Answer:  An effective mediator and/or lawyer will be able to prevent this type of activity utilizing appropriate methods of mediation and/or representation.

Q:  I’ve been a stay-at-home parent and don’t have any money in my own name and my spouse has made all of the money.  How can I afford a divorce?

Answer:  In Illinois, there are laws which enable each of the parties to have appropriate representation regardless of their own personal income.  These laws allow each of the parties to select counsel of their choice to represent them in these matters and the funds are withdrawn from the marital estate.
